Terms of Service
These terms are the agreement between you and us for using the Kitchen Designer AI app. We have kept them short and plain. Nothing here takes away the rights you have as a consumer under Dutch and EU law.

"We", "us" and "our" mean Toob. "You" means you, the user of the app.
2. The service
Kitchen Designer AI redesigns a photo of your own kitchen using generative AI. It offers two flows: composing a look yourself (choosing materials and colours) and taking over the look of a reference kitchen. The result is a new image of how your kitchen could look. How your photo is processed and protected is described in our Privacy Policy.
3. Who may use the app
You must be 16 years or older to use the app. If you are under 18, you may only make purchases with the consent of a parent or guardian, who is responsible for those purchases. The app is not directed at children under 16.
4. No registration
You do not register with us, and you give us no name, email or password to use the app. The free tier and Kitchen AI Pro both work this way. There is nothing for you to set up or manage with us: your subscription is tied to your Apple ID by Apple. To ask us to delete the limited data connected to you, see section 9.
5. Kitchen AI Pro, prices and payment
5.1 The subscription
Kitchen AI Pro is an auto-renewing subscription sold through Apple's In-App Purchase. Apple is the seller of record (in the EU: Apple Distribution International Ltd., Ireland). Plans: weekly and yearly, at the price shown in the App Store before you buy (the App Store always shows the current price in your currency). Payment is charged to your Apple ID at confirmation. The subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Manage or cancel it any time in Settings, under your name, then Subscriptions (or in the App Store under Subscriptions). Deleting the app does not cancel the subscription. Your use of the app is also subject to Apple's Licensed Application End User License Agreement and the Apple Media Services Terms.
5.2 Free designs (not a trial)
New devices get a small number of free designs (currently 3) with no payment details required. This is not a trial and never turns into a paid subscription automatically. Free designs are tied to your device, have no cash value, and may change for the future.
5.3 Fair use
Pro is for normal personal use and has a reasonable daily limit to prevent abuse. If you reach it, the app shows the current limit for that day. We may adjust the limit with reasonable notice.
5.4 Refunds and refund data
Because Apple is the seller, refunds are handled by Apple. You can request one through the App Store using "Report a Problem" or your purchase history at reportaproblem.apple.com. If you ask Apple for a refund, RevenueCat may share anonymous subscription-usage information with Apple so Apple can assess the request. This is device-anonymous, contains no name or email, and is not linked to your identity.
6. Right of withdrawal (paid digital subscription)
Kitchen AI Pro is a digital service that starts immediately. Under EU and Dutch consumer law you normally have 14 days to withdraw from a distance purchase. That right does not apply once performance of an immediately-supplied digital service has begun, provided you gave prior consent and acknowledged that you thereby lose the right of withdrawal.
When you subscribe, Apple's checkout obtains your explicit prior consent to immediate performance and your acknowledgement that you lose the 14-day right of withdrawal, and Apple confirms the purchase on a durable medium. To the extent any withdrawal right still applies, you exercise it through Apple using "Report a Problem" or your purchase history, and refunds are handled by Apple as the seller. Any separate withdrawal-button obligation that applies to online sellers rests with Apple as the seller of record.
This does not limit your statutory conformity rights if the service is faulty or not as described.
7. Acceptable use
When you use the app, you agree that you will:
- only upload photos that you own or are allowed to use;
- not upload photos of other identifiable people without their permission;
- not upload illegal, infringing, hateful, sexual, violent or otherwise harmful content;
- not try to bypass the free-tier metering, device attestation, or other abuse-prevention measures;
- not reverse engineer, disrupt, overload, or gain unauthorised access to the app or our servers, and not use automated means to access the service.
We run an automated safety check on uploaded images and may refuse to process content that is unsafe or violates these terms.
8. AI-generated results
- What Kitchen AI is. Kitchen AI is a visual inspiration and visualisation tool only. Results are AI-generated impressions, not a construction plan, quote, or professional advice. They may be inaccurate or differ from what is actually possible in your room, so always verify with a professional before making purchasing or building decisions.
- Your photos. As between you and us, you keep the rights to the photos you upload. We take no licence or ownership over your photos beyond what is technically needed to send them for processing and return your result to you. We do not claim ownership of your results.
- Using your results. You may use the results you generate for personal and commercial purposes, subject to the AI provider's use policies and applicable law.
- Your responsibility. You confirm that you have the right to upload the photos you use, and you are responsible for how you use the results.
- Marking. Results are marked as AI-generated. See our AI transparency notice.
9. Ending your use and deleting your data
You can stop using the app at any time and delete it. You do not register with us, so there is nothing to close. To request deletion of the limited data tied to you, email [email protected] with the support ID shown in the app under Settings; we delete your entitlement record and RevenueCat customer. Your subscription is managed by Apple and cancelled via the App Store, not by us; your Apple purchase history stays with Apple. We may suspend or end access if you seriously or repeatedly breach these terms, or where we must for legal or security reasons.
10. Our intellectual property
The app itself, its design, name, logo and software are ours or our licensors' and are protected by law. These terms do not give you any rights in them beyond using the app as intended.
11. Disclaimers and liability
The app is provided with care but "as is". We do not guarantee that results meet your expectations or that the service is always available or error-free.
Nothing in these terms limits our liability where the law does not allow it, including for intent or gross negligence, or for death or personal injury. Your mandatory rights as a consumer under Dutch law are not affected. Subject to that, our total liability for any loss arising from the app is limited to the amount you paid to Apple for Kitchen AI Pro in the 12 months before the event that caused the loss, and we are not liable for indirect or consequential loss, including any loss resulting from relying on AI-generated results for building, purchasing or structural decisions.
12. Indemnity
If a third party makes a claim against us because of content you uploaded in breach of section 7 (for example a photo you had no right to use), you will compensate us for the reasonable, direct costs of that claim, to the extent the law allows and the claim is attributable to you.
13. Changes to these terms
We may update these terms, for example when the service changes. If a change is significant we will let you know in the app. The current version and date are shown at the top. This is version 2.0.
14. Governing law and disputes
These terms are governed by Dutch law. Disputes may be brought before the competent Dutch court, without affecting the protections of mandatory consumer law or your right to bring proceedings in the courts of your place of residence. We are not currently affiliated with a consumer disputes committee (Geschillencommissie). You can also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
